With the rise of software patents, engineers coding new stuff - whether within a large software company or as kids writing smartphone apps - are exposed to a claim that somewhere a prior patent is being infringed.

I don't know how much thought is behind it, but it seems to me highly effective the way that Facebook will let somebody tag a photo with a friend's name, then others who are a friend of that friend can perhaps immediately see the photo, and the friend, in the meantime, has a chance to wander back and un-tag it.

In 1979, the Supreme Court ruled 5-3 in Smith v. Maryland that a few days' worth of phone records for a single individual were not protected by the Fourth Amendment. The NSA today, though, collects hundreds of millions of phone records from hundreds of millions of Americans without an individualized warrant.

Having a Congress with a more diverse educational and professional background would serve the country well. And given the budget challenges facing America today, we might benefit from a few more cold, calculating problem solvers, and fewer courtroom impresarios.

There's so much emphasis on Daniel Day-Lewis and his process, which is appropriately his own. But I was just blown away by his generosity as an actor. He's so giving as an actor that he just naturally commands the focus on set.
